1. Acceptance of Terms

By downloading, installing, or using Ascend ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of Service

Ascend is a fitness tracking application that helps you plan and record bodyweight strength training workouts. The app uses the RFEM (Reps From Established Max) methodology to calculate training targets and provides tools for creating training cycles, logging workouts, and tracking progress.

3. Account Registration

• You must be at least 13 years old to create an account
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You are responsible for all activity that occurs under your account

4. Free Trial and Purchases

Free Trial

• New users receive a 4-week free trial with access to all features
• The trial begins when you create your account
• No payment information is required during the trial

In-App Purchases

• Standard ($9.99) — Lifetime access to RFEM training cycles and max testing
• Advanced ($19.99) — Lifetime access to all features including Simple Progression and Mixed cycles

Payment Terms

• All purchases are processed through Apple's App Store
• Prices may vary by region and are subject to change
• Lifetime purchases provide permanent access to purchased features
• Purchases are non-refundable except as required by applicable law or Apple's refund policies

5. Acceptable Use

You agree to use Ascend only for lawful purposes. You may not:

• Use the app in any way that violates applicable laws
• Attempt to reverse engineer, decompile, or disassemble the app
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the app to transmit malware or other harmful code
• Interfere with or disrupt the app's functionality
• Use automated systems to access the app without permission
• Resell or redistribute the app or its content

6. User Content

You retain ownership of any content you create in the app, including exercise names, workout notes, and other user-generated content. By using the app, you grant us a limited license to store, process, and display your content solely to provide the app's functionality.

7. Health and Fitness Disclaimer

• The app does not provide medical advice, diagnosis, or treatment
• Always consult a qualified healthcare provider before starting any exercise program
• Listen to your body and stop exercising if you experience pain or discomfort
• The workout suggestions and targets are based on mathematical formulas and may not be appropriate for everyone
• We are not responsible for any injuries that may occur while following workouts tracked in the app

8. Intellectual Property

The app, including its design, code, graphics, and content (excluding user content), is owned by BetterDays and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the app without our written permission.

9. Privacy

Your use of Ascend is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Termination

We reserve the right to suspend or terminate your access to the app at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting it through the app's settings.

Upon termination:

• Your right to use the app will immediately cease
• You may lose access to your workout data if it was only stored in the cloud
• Any purchases made prior to termination are non-refundable

11. Disclaimer of Warranties

We do not warrant that:

• The app will be uninterrupted or error-free
• Defects will be corrected
• The app is free of viruses or harmful components
• The results from using the app will meet your requirements

You agree to indemnify and hold harmless BetterDays from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of the app after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterDays regarding your use of the app and supersede any prior agreements.
